Accommodation & Tours CANCELLATION POLICY

Flexible: Full refund within a limited period

For cancellations by Guests, cancellation charges depend on when Magic City Tours receives notice of the cancellation. Refunds usually take a 21 days for processing. All Refunds are paid in 3 or less installments. Payments are made via Direct deposits, MMG or Cash pickup at our office. Minimum cancellation charges are as follows:

Guided Tours & Excursions:

60 days prior to tour date: Full Refund

45 days prior to tour date: 50% Cancellation Fee

30 days prior to tour date: 70% Cancellation fee

Less than 25 days prior to tour date: No Refund

All cancellations of, or changes are subject to applicable restrictions. Magic City Tours will apply any payments made toward the purchase price against any cancellation charges and will refund any balance remaining after the payment of any charges. In order to receive a refund, if applicable, client must request and receive a cancellation confirmation number. The cancellation charges outlined above are liquidated damages and not a penalty. Holiday periods may be subject to additional cancellation charges. NO REFUNDS OR ADJUSTMENTS WILL BE MADE FOR ANY PORTION OF TOUR OR ATTENDANT SERVICES NOT UTILIZED.

Refund Policy:
No refunds or adjustments will be made for any portion of your tour not utilized.

Changes to Reservations:
All requested changes to reservations are subject to Magic City Tours’ sole discretion, and any changes must be approved in writing. Customers are allowed to reschedule an already secured reservation to a future date that’s at most 6 months into the future. No Refunds are available if a customer-rescheduled tour is later cancelled after being rescheduled.

Force Majeure Clause
In the event of a Force Majeure, Magic City will not be held liable for its inability to fulfill its
obligations under this refund policy. A Force Majeure is defined as any event or condition
beyond the reasonable control of Magic City that prevents or delays performance, including
but not limited to:

• Natural disasters (e.g., hurricanes, earthquakes, floods)
• Acts of God
• War, terrorism, or acts of civil unrest
• Governmental actions, including lockdowns, restrictions, or regulations
• Epidemics or pandemics
• Labour strikes or industrial disputes
• Utility failures or interruptions in essential services (e.g., electricity, water, internet)
  Policy Details:

1. Event Postponement or Cancellation:
   o If an event is postponed or canceled due to a Force Majeure, Magic City will
   endeavor to reschedule the event to a future date.
   o Tickets or reservations will remain valid for the rescheduled event.

Refund Requests:

o Refunds will be issued only if rescheduling is not possible and at the sole
discretion of Magic City.
o Administrative fees or third-party charges incurred during the booking process
may be non-refundable.

Customer Responsibility:

o Customers are encouraged to monitor communications from Magic City
regarding updates related to Force Majeure events.

2. Interrupted Tours:
   Continuation or Resumption of Tour:

o If possible, Magic City will make reasonable efforts to continue or resume the
tour once conditions permit.
o Adjustments to the itinerary may be made to accommodate changes caused by
the Force Majeure event.

Alternative Arrangements:

o If the tour cannot continue as planned, Magic City will assist in organizing
alternative arrangements, such as rescheduling or rerouting. The customer may
be responsible for additional costs incurred for alternative arrangements.

Refunds or Credits:

o Partial refunds or credits may be offered at Magic City’s sole discretion
based on the portion of the tour completed or services not rendered.
o Refunds will exclude any non-recoverable expenses already incurred by
Magic City (e.g., hotel deposits, transportation fees).

Customer Responsibilities:

o Customers must cooperate with Magic City and follow instructions during
disruptions for their safety and security.

Acknowledgment of Risk:
By booking with Magic City, customers acknowledge and accept the risks associated with
Force Majeure events and agree to the terms outlined in this clause.

*Magic City Tours operates and owns the tours identified above, such that there exists a relationship of master and servant or of agency. With the exception of these tours and other tours openly advertised as owned by Magic City Tours & Transportation Services, the relationship between Magic City Tours and an Operator of tours advertised and/or available for sale by Magic City Tours is that of an independent contractor to which Terms & Conditions that may affect your legal rights apply.
